Heb je een snelheidsboete in de bus gekregen? Je zal niet de eerste zijn die dat overkomt. Per jaar worden er in Nederland zo’n 8 miljoen boetes opgelegd. Meer dan 80 procent van deze boetes is een snelheidsboete. Wat zijn je rechten als het aankomt op snelheidsboetes? Het is namelijk niet zo dat je helemaal niets kunt doen tegen het krijgen van een snelheidsboete.

Welke type snelheidsboete bestaan er?

Er bestaan diverse type boetes voor te hard rijden. Zo heb je boordsnelheidsmetingen. Hier rijdt de verbalisant in een voertuig en blijft op gelijke afstand rijden met voertuig dat hij aan het meten is. Je ziet dit soort metingen vooral in programma’s zoals Blik op de Weg en Wegmisbruikers. Er zijn snelheidsboetes die worden gegeven via vaste radarapparaten, zoals een flitspaal. Daarnaast heb je mobiel radarapparaten. En ten slotte heb je de detector snelheidsmeter. Dit is een speciaal apparaat dat gebruik maakt van lussen in de weg. Op basis van de eerste en de tweede lus wordt berekend wat de snelheid van het voertuig is.

Wat kun je doen tegen boordsnelheidsmetingen?

Met een meting zoals de boordsnelheidsmeting is het zaak voor de verbalisant om een redelijk afstand aan te nemen. Volgt een verbalisant je 2 of 3 seconden dan betekent dat hij geen betrouwbare snelheidsmeting kan verrichten. 16 seconden zijn aannemelijk voor een redelijke volgafstand. Dat betekent niet gelijk dat 15 seconden niet meer betrouwbaar is, maar 7 of 8 seconden zijn echt te kort.

Snelheidsboete bij mobiele en vaste radarapparatuur

Heb je een boete gekregen bij vaste randapparatuur dan moet je beoordelen of je voertuig is gemeten en of dat duidelijk zichtbaar wordt op de foto’s. Zijn er op de foto’s meerdere voertuigen te zien? Dan is het aan de officier om te bepalen of jouw voertuig is gemeten. Laat je hierbij niet zomaar afpoeieren. Met mobiele randapparatuur heb je de meeste kans. Dat komt omdat deze vorm van meten van snelheid erg afhankelijk is van de kennis en kunde van de desbetreffende verbalisant. Het gaat hier immers niet om een standaardprocedure en de verbalisant moet de nodige werkzaamheden verrichten. Daar kunnen fouten insluipen.

Hoe zit het met de hoogte van het bedrag van de snelheidsboete?

Als je gaat kijken naar de hoogte van de boetes dan merk je op dat dit elkaar jaar weer een stukje hoger wordt. Zo betaal je voor 10 kilometer hard te rijden 69 euro. Voor 15 kilometer hard te rijden 133 euro en voor 25 kilometer harder te rijden 252 euro. Dit zijn bedragen die gelden voor buiten de bebouwde kom. Rijd je bijvoorbeeld 5 kilometer te hard op een snelweg dan betaal je 31 euro aan een snelheidsboete.

Hoe zit het met forse snelheidsovertredingen?

Bega je op de weg een forse snelheidsovertreding dan kan dat vallen onder het strafrecht. De officier kan voor meerdere veelvoorkomende verkeersovertredingen zelf de straffen

opleggen. Dit kan gaan door middel van een OM strafbeschikking. Deze beschikking is meestal een forse boete en de CJIB verzendt dit. Overigens wordt een strafbeschikking ook gedocumenteerd. Dat betekent dat je een strafblad krijgt naast een snelheidsboete.
